Terms and Conditions

1. Acceptance of terms

Africa Opportunities Portal ("The Service") is an information service from Platinum Integrations Ltd. ("Pi" or "We"). By registering with the Service, you ("User" or "you") agree to be bound by all of the terms and conditions set forth below. Pi may change the terms in this Agreement at any time without notice to you. When the terms are changed, the changes will appear in this document. By using the Service after any change in the Agreement is posted, you agree to be bound by all of the changes as well. You should consult this page each time you access the Service.

2. Login and Password

Access to and use of the Service is through a combination of a user name ("login") and password. You agree that such access will not be shared with others. You may not access the Service using the login or password of any other party. Users are responsible for maintaining the confidentiality of their login and password. Users shall be responsible for all uses of their login, whether or not they are authorized. Users agree to immediately notify Pi of any unauthorized use of their login or password.

3. Fees, Payment and Cancellation Policy

Full access to the Service requires payment of fees. Users shall pay all appropriate fees, in accordance with the selected subscription model. Pi reserves the right to change its fees or services and/or to institute new charges at any time, with notice provided via email to the email address provided by user at time of registering. Use of the Service by the user following notification shall constitute acceptance of any new or increased charges. Users have 30 days from the date that any discrepancies in the confirmation email of their order first appear to notify Pi; after that time all charges will be deemed correct.

4. Limited Use

You acknowledge and agree that all content and all materials available through the Service is the property of Pi or its licensors and may be protected by copyright and other intellectual property laws. Information received through the Service may be displayed, reformatted and printed only to the extent permitted by applicable licenses for use by you or your company or organization as end users, and not for resale. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the information received through the Service to anyone, outside your company or organization, without the express prior written consent of Pi, with this one exception: Users may, on an occasional and irregular basis, include insubstantial portions of information from the Service in memoranda, reports and presentations, but only if such memoranda, reports and presentations are distributed or otherwise made available to a limited number of individuals, companies or organizations. Users must include in all such memoranda, reports and presentations any applicable copyright notices from the information used, original source attribution, and the phrase "Reprinted with permission of Platinum Integrations Ltd." Users may not post any content from the Service to newsgroups, mail lists or electronic bulletin boards, without the prior written consent of Pi. Systematic retrieval of data or other content from this site to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from Pi is prohibited. Pi reserves the right to discontinue or change the Service, or its availability to you, at any time without notice.

5. Disclaimer of Warranties and Liability

Due to the number of sources from which information on the Service is obtained, and the inherent hazards of electronic distribution, there may be delays, omissions or inaccuracies in such information and the Service. Platinum Integrations Ltd and its affiliates, agents and licensors provide the service “as is” and cannot and do not warrant the accuracy, completeness, current-ness, non-infringement, merchantability, or fitness for a particular purpose of the information available through The Service, or the service itself. Neither Platinum Integrations Ltd, nor any of its affiliates, agents, or licensors shall be liable to users or anyone else for any loss or injury caused in whole or in part by its negligence or circumstances beyond its control in procuring, compiling, interpreting, reporting, or delivering The Service and any information through The Service. In no event will Platinum Integrations Ltd, its affiliates, agents or licensors be liable to users or anyone else for any decision made or action taken by them in reliance on such information or for any consequential, special or similar damages, even if advised of the possibility of such damages. Users agree that the liability of Platinum Integrations Ltd, its affiliates, agents and licensors, if any, arising out of any legal claim (whether in contract, tort or otherwise) in anyway connected with The Service or the information in The Service shall not exceed the amount users paid to Platinum Integrations for use of The Service.

6. Miscellaneous

This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision of this Agreement is invalid under applicable law, the remaining provisions will continue in full force and effect. This Agreement, all intellectual property issues, and your rights and obligations shall exclusively be governed by and construed in accordance with the laws of United Kingdom and any disputes shall be subject to the jurisdiction of the courts of United Kingdom, unless otherwise submitted by Platinum Integrations Ltd.

 

Purchase Terms and Conditions

1. Restrictions on Use

1.1 The use of information (“Information”) is subject to these terms and conditions (“Terms of Use”). The Information is licensed to you (“End User”) for End User’s internal business use only in the territory in which it is purchased. Such license is non-exclusive, non-transferable and limited for the Term (as defined in Section 8.2 below) and is subject to the restrictions set forth herein. We retains all ownership rights (including copyrights, database rights under the Database Regulations 1997 and other intellectual property rights) in the Information in any form and End User obtains only such rights as are explicitly granted in these Terms of Use.
1.2 End User shall not request or make available Information for the use of others, including for any parent, subsidiary, affiliated entity, franchisee or dealer of End User. End User shall not make Information available to others in any form, unless required by law where End User has notified us or unless End User first obtains our written consent.
1.3 End User shall not use Information in connection with providing advice or recommendations to others, publish Information in the news media, incorporate or use Information in any kind of database or marketing list to be provided to a third party, use Information to generate any statistical or other information that is or will be provided to third parties, use or permit the use of Information to prepare any comparison to other information databases that will be provided to third parties, or produce Information in judicial or administrative proceedings, including discovery proceedings, without our prior written consent, unless required by law and where End User has notified us of such legal requirement.
1.4 End User may use Information only in connection with the particular transaction for which such Information was originally requested. End User shall not re-license, resell or further distribute Information.

2. Copying

End User shall not copy, download, batch harvest, upload or in any other way reproduce the Information for the purpose of aggregating the Information, save that End User may create a copy or backup of the Information for the purpose of maintaining an internal archive or for regulatory compliance. Such backup or archive shall not be used for any commercial purpose.

3. Compliance With Laws

3.1 End User will not use Information as a factor in establishing an individual’s eligibility for (i) credit or insurance to be used primarily for personal, family, or household purposes, or (ii) employment. In addition, End User will not use Information to engage in any unfair, anti-competitive or deceptive practices and will use the Information only in compliance with applicable laws or regulations, including laws and regulations regarding telemarketing, customer solicitation (including fax and/or e-mail solicitation), data protection, privacy and anti-corruption.
3.2 End User acknowledges that it shall comply with its obligations under the Data Protection Act 1998 and where applicable the Consumer Credit Act 1974 in relation to this Agreement.
3.3 In relation to personal data contained in the Information, End User undertakes to comply with the following obligations: (i) to use such personal data only for internal business use in connection with the particular transaction for which the Information was originally requested; (ii) to ensure that such personal data is only used by appropriate authorized and trained personnel; (iii) to take and maintain appropriate technical and organizational security measures and procedures to safeguard such personal data from accidental loss or unauthorized disclosure; and (iv) subject to the requirements of the Data Protection Act 1998, to keep such personal data strictly confidential.

4. Limitation of Liability

4.1 END USER AGREES THAT IN NO EVENT SHALL WE (OR ITS AFFILIATES) BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND OR CHARACTER (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES ARISING OUT OF THE USE OF OUR INFORMATION, INCLUDING WITHOUT LIMITATION ANY LOSS OR DAMAGES ARISING OUT OF ANY CREDIT DECISIONS MADE, ANY LOSS OF PROFIT, SAVING OR GOODWILL, AND ANY LOSS OR DAMAGE ARISING OUT OF THE CONDUCT OF THIRD PARTIES.
4.2 IN NO EVENT SHALL OUR LIABILITY UNDER THIS AGREEMENT EXCEED THE GREATER OF (I) THE AMOUNT PAID FOR THE PARTICULAR INFORMATION PROVIDED TO END USER THAT IS THE SUBJECT OF THE CLAIM OR (II) A SUM EQUIVALENT TO GBP 20,000

5. Disclaimer of Warranties

5.1 Though we use extensive procedures to keep its database current and to maintain accurate data, End User acknowledges that the Information will contain a degree of error. End User accepts that it (i) is responsible for determining whether the Information is sufficient for End User’s use and (ii) must rely entirely upon its own skill and judgment when using the Information.
5.2 ALL INFORMATION IS PROVIDED ON AN “AS IS”, “AS AVAILABLE” BASIS. SAVE AS OTHERWISE STATED IN THESE TERMS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, COMPLETENESS, CURRENTNESS, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE WILL NOT BE LIABLE FOR ANY LOSS OR INJURY ARISING OUT OF, IN WHOLE OR IN PART, OUR CONDUCT IN PROCURING, COMPILING, COLLECTING, INTERPRETING OR REPORTING INFORMATION.

6. Intellectual Property

End User acknowledges and agrees that the Information is proprietary to us and comprises: (a) works of original authorship, including compiled information containing our selection, arrangement and coordination and expression of such information or pre-existing material it has created, gathered or assembled; (b) confidential and trade secret information; and (c) information that has been created, developed and maintained by us at great expense of time and money, such that misappropriation or unauthorized use by others for commercial gain would unfairly or irreparably harm us. End User agrees that it will not commit or permit any act or omission by its agents, employees, or any third party that would impair our copyright, database rights or other proprietary and intellectual rights in the Information. End User will not use any of our trade names, trademarks, service marks or copyrighted materials in listings or advertising in any manner without our prior written approval. Where required by us, End User shall reproduce our copyright notice and proprietary rights legend on all authorized copies of such Information.

7. Indemnification

End User agrees to indemnify, defend and hold us harmless from any claim or cause of action against us arising out of or relating to use of the Information by: (i) individuals or entities which have not been authorized by this Agreement to have access to and/or use the Information; and (ii) End User, except where such use by End User is in accordance with these Terms of Use.

8. Miscellaneous

8.1 Notwithstanding any provision in these Terms of Use, our liability to End User for death or injury resulting from its own or that of its employees’, agents’ or subcontractors’ negligence, or for fraudulent misrepresentations, shall not be limited.
8.2 The term of End User’s license for any particular Information (or element thereof) is one (1) year from the date such Information is obtained by End User (the “Term”). We may terminate such license immediately upon written notice to the End User in the event of End User’s breach of these Terms of Use.
8.3 This Agreement is governed by and construed in accordance with the laws of England and both parties irrevocably submit to the exclusive jurisdiction of the English Courts.
8.4 Without prejudice to any other rights that we may have under this Agreement or at law, if in our reasonable opinion the End User has violated these Terms of Use, we may suspend End User’s access to the Information while the violation is investigated. Any investigation will be carried out promptly and End User agrees to cooperate with us in connection with any such investigation.
8.5 End User agrees that this Agreement is entered into between End User and us.
8.6 Upon expiry or termination of the Term with respect to the Information, End User shall immediately delete, destroy or return all originals and copies of any Information, unless End User is otherwise instructed by us, and upon request shall provide us with certification thereof. This provision shall not apply to the archival copies of the Information as permitted in Section 2 above.

Privacy Policy


This privacy policy sets out how Platinum Integrations uses and protects any information that you give Platinum Integrations when you use this website.
Platinum Integrations is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.
Platinum Integrations may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 10/10/2011.

What we collect

We may collect the following information:
•    name and job title
•    contact information including email address
•    demographic information such as postcode, preferences and interests
•    other information relevant to customer surveys and/or offers

We do not collect or hold any of your financial information.

All financial transactions are carried out by third party gateways like: PayPal, WorldPay, SagePay via encrypted secure links.


What we do with the information we gather
